Our services: domain name disputes

We help clients who:

  • find that another person has registered a domain name incorporating their trade mark or trade name;
  • lose their domain name to another person, for example because they accidentally fail to renew the domain name; or
  • otherwise find themselves involved in a domain name dispute or domain name arbitration proceedings.

If you have any of these problems, we have the solutions.

Our solutions

We can assist you with negotiations relating to domain name disputes and, where necessary, represent you in domain name arbitration proceedings.

Although domain name arbitrations are generally much less expensive than court litigation, the costs can be prohibitative where the domain name itself is not of any great value. For this reason, it is often commercially sensible arrange a negotiated settlement to a dispute.

Sometimes a cybersquatter will refused to sell a domain for a reasonable price; and sometimes trade mark owner will have another good reason not to settle a dispute. For instance, the trade mark owner may not want to encourage more cybersquatting, or may on principle refuse to make a payment to a cybersquatter.

In these situations, domain name arbitration proceedings may be employed to recover the domain name.

Both complainants and respondents in domain name proceedings sometimes represent themselves. However, in our experience you are significantly more likely to achieve a favourable outcome if you obtain professional advice and representation.

If, nonetheless, you plan to represent yourself, you are more than welcome to make use of the Internet Library of Cybersquatting and Domain Name Disputes. This is a comprehensive index of web-based domain dispute related materials and resources hosted on this website.

Professional representation

Although domain name arbitration proceedings are supposed to be an inexpensive way of resolving disputes, solicitors' fees often mean that they are not.

That's where we come in. We have been involved in a large number of domain name disputes. Our principal consultant, Al Taylor, has advised and represented clients involved in domain disputes at two major law firms. However, our (fixed) fees are a fraction of what you might expect to pay for a similar standard of representation from a large law firm.

What are you waiting for?

Time is usually of the essence in a domain dispute. Potential complainants will want to file their complaints as soon as possible, before the domain name is transferred on. Once proceedings have started, the clock will be ticking and deadlines will have to be met.
